A High School Teacher Sues TSC Over Sex Allegations With A School Girl.
A secondary school teacher who was sacked three years ago in Kitui for allegedly eloping with a student has filed a lawsuit against the Teachers Service Commission (TSC) seeking reinstatement.
According to Nikolas Kivuva, a former teacher at Katulani Secondary School in Kitui, has decided to sue TSC for the alleged sex relationship with a schoolgirl managed by the platform.
Nicolas Kivuva has now filed an application in the Employment and Labor Relations Court through his lawyer John Swaka and the hearing of the case is scheduled for April 26.
The teacher has stated in his application that he was dismissed out of malice and was given an opportunity to defend himself.
He says he was falsely accused of having a sex relationship with a student at a former school he was teaching before he was transferred.
The teacher says that the allegation was vehemently dismissed by the student.
In its application, Kivuwa said that there were several fake hearings on different dates and they were not given a fair trial.
Kivuwa, who was a teacher at Katulani Boys Secondary School until its completion, claimed in her application that the student confirmed at the hearing that she was coerced by another person who was the orchestrator of the entire saga to implicate her.
In his application the former teacher says that despite serious allegations of sex misconduct leveled against him, no report was made to any police station.
And upon the birth of her child, Kivuwa says that the girl revealed who the father of her child was.
“At no point was any DNA done to verify that the child was the applicant even after the birth of the student. The hearing proceeded without any evidence to demonstrate any alleged sexual relationship between the student and the claimant,” says Kivuwa through his lawyer.
The teacher is also seeking compensation for increased damages and the cost of the suit, along with special damages, unpaid pay, unpaid terminal dues, general damages, and interest on all four.
