President William Ruto has suffered a major blow after a three-judge bench declared the 50 positions of the Chief Administrative Secretaries unconstitutional.
High Court judges Kanyi Kimondo, Hedwig Ong’udi and Visram Alnashir found that the appointment of the CASs did not comply with the stipulated constitutional process.
The creation of 50 CAS had to comply with the constitution and principles set out in the judgment in a 2021 case filed by Senator Okiya Omtatah, in order to be lawfully established. The judges found that it did not.
On March 24, Justice Ongúdi granted Conservatory Orders barring CASs from assuming or continuing to act as Chief Administrative Secretary until the Hearing of a case by the Law Society of Kenya and the Katiba Institute.
