The Teachers Service Commission (TSC) and two teachers’ unions have criticised the Ministry of Education’s new legislation regarding the selection of school principals.
According to the Draught Basic Education Regulations 2014, the ministry desires that the Cabinet Secretary appoint all heads of institutions.
The TSC has maintained that it is its duty to hire and promote all teachers, along with the Kenya National Union of Teachers (Knut) and the Kenya Union of Post Primary Education Teachers (Kuppet).
If the idea is approved, all school principals will need to reapply for their jobs.This might imply that the TSC will no longer be able to choose her own immediate agent.
New personnel may be hired to run schools in conformity with the law if incumbent principals are found to be unable to manage school resources.
In accordance with the current laws, each institutional director has a five-year term and is eligible for reappointment for two additional terms of similar length.
Re-appointment criteria will be based on a candidate’s performance throughout the previous five years of service in the same position.
The regulations specify that after serving two terms of five years at the same institution, an official may be reappointed for a third term to work at another school.
The Basic Education Regulations 2014’s Part 92 contains some concepts. Tuesday, Knut and Kuppet rejected the recommendation, describing it as “dishonest and almost provocative.”
They stated that the ministry has no right to hire additional employees because only the TSC is authorised to do so legally.
Additionally, it was revealed that union leaders and ministry representatives met last week and reached an understanding on a number of contentious passages, only for the government to “break” the agreement.
