Former Interior Cabinet Secretary Dr. Fred Matiang’i has moved to court asking to be issued with an anticipatory bail to bar his impending arrest.
Dr. Matiang’i cites Wednesday’s incident in which police officers allegedly raided his home, surrounded and cordoned it off with an aim of arresting him.
The officers he adds only retreated upon the arrival of the media and his lawyers amid claims the alleged raid was stage managed.
“The Applicant has received credible information from officers of the Kenya Police that they are under express instructions to arbitrarily capture and arrest him with a view of arraigning him in Court for ulterior political motives,” says Dr. Matiang’i lawyer Danstan Omari.
“Worth noting is the fact that the Applicant has never been summoned to appear before any police station or investigative agency and no arrest warrants had been issued against him, a clear breach of due process.,” added Omari who termed the application as a matter of extreme urgency.
The Directorate of Criminal Investigations, the National Police Service, the Director of Public Prosecutions, the Ethics and Anti-Corruption Commission, the Independent Police Oversight Authority, the National Police Service Commission, the Kenya National Commission on Human Rights and the Law Society of Kenya have all been cited as respondents in the matter.
The Inspector General of Police Japhet Koome has since denied claims his officers raided Dr. Matiangi’s home in Karen last night.
“There is no officer under the National Police Service who was at the former CS home. We have checked and I can confirm that,” clarified Koome.
The Ethics and Anti-Corruption Commission Chief Executive Officer Twalib Mbarak has too denied his officers were involved in the said attempted raid.
“We are not aware. Those if any are not EACC officers. We have nothing against him,” he said.
