The Director of Public Prosecutions Noordin Haji has now said that there is no adequate evidence provided to open a case on former Interior Cabinet Secretary Fred Matiang’i in relation to a raid in his Karen home last month.
Noordin Haji in a statement, said the Directorate of Criminal Investigations could not provide evidence to sustain two charges leveled against the former Interior Cabinet Secretary.
The recommendation by the investigating officer was that Dr. Fred Okeng’o Matiang’i and his advocate Mr. Danstan Omani be charged for the following offences: (a) Conspiracy to commit a felony contrary to section 393 of the Penal Code. (b) Publication of false information contrary to section 23 of the Computer and Misuse and Cybercrime Act No. 5 of 2018.
Upon independent and thorough analysis of the evidence availed and a review of the statements of the witnesses, the Director of Public Prosecutions found that the evidence provided was not sufficient to sustain the above charges against former CS Dr. Fred Okeng’o Matiang’i and his advocate Mr. Danstan Omani.
Noordin Haji stated that the evidence provided did not meet the threshold needed to prove each of the afore-mentioned offences as required by law.
He further asked the DCI to drop the charges with immediate effect.”The Director of Public Prosecutions has therefore directed the Directorate of Criminal Investigations to close the inquiry file with no further police action,” he added.
